Terms and Conditions of Business (March 2022)
1. General
1.1 These terms and conditions (the “Terms”) apply to every contract entered into between Lance McNulty Photography (“LMP”) and any person, firm or company (the “Customer”) through www.atelier-mcnulty.com (the “Website”).
1.2 The Website is LMP’s online marketing for the sale of photographic fine art prints.
1.3 Any contract between LMP and the Customer will be governed by English law.
2. Use of Prints
2.1 Prints are intended for personal use as a private display only.
2.2 For other uses, including (but not limited to) an editorial, commercial or business use, please contact LMP, via the Website “Contact” page, regarding licencing.
2.3 Copyright in all images used for the prints remains with LMP.
3. Prints
3.1 Print sizes and printed area dimensions are approximate.
3.2 Printed area dimensions will vary according to the format of the original film scan or digital file reproduced.
3.3 Prints have a white paper border to allow for mounting, the border width also varying as per 3.2 above.
4. Reproduction of Print Images on the Website
4.1 LMP makes every effort to display print tones and colours on screen that closely match delivery prints, but it is not possible to reproduce them exactly and they may not display accurately on a Customer’s screen.
4.2 Print images on the Website are therefore for illustrative purposes only.
5. Prices and Payment
5.1 All Website prices are in GBP and include VAT.
5.2 Delivery and shipping costs are charged in addition.
5.3 Orders must be paid for in advance, via the payment methods specified on the Website.
6. Shipping and Delivery
6.1 Prints are shipped rolled in a protective cardboard tube via one of the Royal Mail tracking services or a courier service, at LMP’s discretion.
6.2 Delivery times may vary, as each print is made individually to order by LMP.
6.3 All print orders will be fulfilled and dispatched as soon as possible, but delivery may take up to a maximum of 30 days during busy periods.
6.4 Provided LMP has received the Customer’s email address when their order is placed, LMP will notify the Customer by email when their order is dispatched.
7. International Orders and Customs Duties
7.1 International taxes, customs and import duties are not included in Website prices and the Customer is solely responsible for the payment of such.
7.2 Prior to placing an order via the Website, it is therefore the responsibility of the Customer to ascertain all taxes, customs and import duties applicable to delivery of an order in the Customer’s country.
8. Returns
8.1 Prints are made to individual order and consequently there is no right of return.
8.2 Clause 8.1 does not affect a Customer’s statutory right to return damaged or faulty goods. In the unlikely event of a print fault ordamage to prints in transit, please notify LMP immediately on receipt, using the Website “Contact” page.
9. Order Amendments
9.1 To amend an existing order, please contact LMP via the Website Contact page as soon as possible.
9.2 Print orders cannot be amended once LMP has printed the order for dispatch.
10. Liability
10.1 LMP will not be liable for failure to perform any contract between LMP and the Customer due to circumstances beyond LMP’s control including (but not limited to):
10.1.1 inability to secure labour, materials, equipment or transport; or
10.1.2 scarcity of fuel or power; or
10.1.3 fire, storm, flood, act of God, war, civil disturbances, strikes, lockout or industrial action (in any form).
10.2 LMP makes no warranty as to the accuracy of the information in print titles or print captions on the Website.
10.3 The extent of LMP’s liability for any breach of the Terms shall be limited to the value of the Customer’s print order.
11. Amendment of Terms
These Terms may be amended from time to time and it is the responsibility of the Customer to check for changes to the Terms before placing any order and making a purchase.
